5. Payment Terms
The following payment terms apply to all orders placed through the Website:
5.1 Pricing
All prices listed on the Website are in United States Dollars (USD) and are subject to applicable state and local sales taxes. Prices are subject to change at any time without notice. The price charged for an order will be the price in effect at the time the order is placed and confirmed.
5.2 Payment Methods
We accept major credit and debit cards (Visa, MasterCard, American Express, Discover) and other payment methods as may be specified at checkout. By providing payment information, you represent and warrant that you are authorized to use the payment method provided and that the billing information you supply is accurate and complete.
5.3 Order Confirmation
An order is not considered accepted or confirmed until you receive an order confirmation from us. We reserve the right to refuse or cancel any order at any time, including after confirmation, for reasons including but not limited to product unavailability, errors in pricing or product information, or suspected fraudulent activity. In the event of a cancellation following payment, a full refund will be issued to your original payment method.
5.4 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally considered final once an order is confirmed and prepared. Refunds may be issued at our discretion in cases where the order is incorrect, does not meet reasonable quality standards, or is not delivered as promised. Refund requests must be submitted to [email protected] within 24 hours of the order. We comply with all applicable consumer protection standards under the Federal Trade Commission Act (15 U.S.C. § 45) and applicable state laws.
5.5 Taxes
You are responsible for all applicable taxes, fees, and charges associated with your purchases through the Website, including state and local sales taxes. Tax amounts are calculated at checkout based on your delivery or pickup location.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE WEBSITE OR PURCHASE OF OUR PRODUCTS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO ANTHONY'S COAL FIRED PIZZA IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some states do not allow the exclusion of implied warranties or limitation of incidental or consequential damages, so some of the above limitations may not apply to you. In such cases, our liability shall be limited to the greatest extent permitted by applicable law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza, its parent company, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

9. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and sharing of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Website, you consent to the practices described in our Privacy Policy.
To the extent that California residents use our Website, certain rights may be available to them under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know, delete, opt-out of sale, and non-discrimination. Please refer to our Privacy Policy for full details or contact us at [email protected].
10. Governing Law and Jurisdiction
These Terms of Service, and all disputes arising out of or related to these Terms or your use of the Website, shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Anthony's Coal Fired Pizza is incorporated or maintains its principal place of business, without regard to its conflict of law provisions.
To the extent that any claim is not subject to binding arbitration as described in Section 11, you irrevocably consent to the exclusive personal jurisdiction of the federal and state courts located within the United States for the resolution of any such claim or dispute. You waive any objection to the laying of venue of any such proceeding in those courts and any claim that such proceeding has been brought in an inconvenient forum.
These Terms are subject to applicable federal consumer protection law, including the Federal Trade Commission Act (15 U.S.C. § 45), which prohibits unfair or deceptive acts or practices in commerce. Nothing in these Terms shall be construed to limit any rights you may have under applicable federal or state consumer protection statutes.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first attempt to resolve any dispute, controversy, or claim arising out of or relating to these Terms, the Website, or our products and services by contacting us informally at:
We will attempt to resolve your concern within thirty (30) calendar days of receiving your written notice. If we are unable to resolve the matter informally within that period, either party may proceed to binding arbitration as set forth below.
11.2 Binding Arbitration
EXCEPT AS OTHERWISE PROVIDED IN THESE TERMS, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, OR VALIDITY THEREOF, SHALL BE FINALLY RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, WHICH ARE INCORPORATED HEREIN BY REFERENCE. The arbitration shall be conducted in English and shall take place in the United States. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
11.3 Class Action Waiver
YOU AND ANTHONY'S COAL FIRED PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, YOU AND ANTHONY'S COAL FIRED PIZZA EACH WAIVE ANY RIGHT TO A JURY TRIAL.
11.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights, trade secrets, or confidential information, without first engaging in the informal dispute resolution process described above.
12. Term and Termination
12.1 Duration
These Terms are effective as of the date you first access or use the Website and shall remain in full force and effect for as long as you continue to use the Website or maintain an account with us, unless earlier terminated as provided herein.

14. Severability
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, void, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be deemed severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect and shall not be affected or impaired by such invalidity, illegality, or unenforceability.
The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of such provision in any other jurisdiction.
15. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by Anthony's Coal Fired Pizza on the Website, constitute the entire agreement between you and Anthony's Coal Fired Pizza concerning your use of the Website and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, between you and Anthony's Coal Fired Pizza relating to the subject matter herein.
No waiver by Anthony's Coal Fired Pizza of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
16. Force Majeure
Anthony's Coal Fired Pizza shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, governmental actions or restrictions, labor disputes, civil unrest, war, terrorism, fire, flood, utility failures, internet or telecommunications disruptions, or supply chain interruptions. In such events, our obligations shall be suspended for the duration of the force majeure event.
17. Electronic Communications
